May 17, 2019Mandelbaum Salsburg Participated in the Say Thank You Selfie Challenge Through Operation Gratitude

In honor of Military Appreciation month the attorneys and staff of Mandelbaum Salsburg participated in the #SayThankYouSelfie Challenge through #OperationGratitude! We challenge all of our clients, friends and families to join us in showing #gratitude to the service men and women both home and abroad with this fun and unique campaign. To take part in this Operation Gratitude event, all you need to do is: 1. Take a picture or video of yourself saying "Thank You" or holding up a handwritten sign. Have your loved ones, children, friends or pets join you, and make it a family affair! You can even personalize your message for someone you know who is currently serving in the Military. 2. Upload your selfie to any social media platform and add the hashtags #SayThankYouSelfie and #OperationGratitude. Tag your friends and co-workers as well, and challenge them to participate! Pictures with the hashtags will be included in a special edition of the Operation Gratitude magazine, which will be placed in every single one of the 500,000+ Care Packages they'll send over the next year....

Congratulations to the Essex County Bar Association, Essex County Prosecutor's Office, Newark Police Department and Essex Sheriff's Office on their successful gun buyback initiative which took over 300 guns off the streets of Essex County this past weekend. March 5, 2019Arla Cahill Receives Great Result for Client in a Case Involving a Corporate Officer Being Held Personally Liable for Past Company's Debts

On March 5, 2019, Mandelbaum Salsburg Member Arla D. Cahill successfully defeated a plaintiff's motion for summary judgment and prevailed on a cross-motion for summary judgment that dismissed a complaint for $125,000 entirely and with prejudice in favor of the firm's client. The complaint sought to hold the client, a corporate officer, personally liable for the alleged debt of a defunct New Jersey corporation based on an unsigned credit agreement containing a joint and several liability provision that plaintiff sought to enforce under Utah law. The court rejected plaintiff's argument that use of a corporate credit card constituted an agreement by the officer to be personally liable for the company's charges. The court also found no evidence that the proffered credit agreement was the original agreement issued for the company's account or any other evidence justifying personal liability. Applying New Jersey law, the court found that, unlike Utah law, unsigned personal guarantees and unilateral, inconspicuous "bill stuffer" amendments to material terms of credit agreements are unenforceable. Because this was the second time this plaintiff filed suit against the corporate officer, the court also found that the suit was barred by New Jersey's entire controversy doctrine....
